Terms of Service
Last updated · 10 April 2026These Terms of Service ("Terms") govern your use of CheckMail, an email verification API operated by Bition B.V. ("we", "us"), a Dutch private limited company registered with the Netherlands Chamber of Commerce under KvK number 95743731 and VAT number NL867271966B01, with its registered office at Verdunplein 17, 5627SZ Eindhoven, the Netherlands.
By creating an account, generating an API key, or otherwise using CheckMail, you agree to these Terms. If you do not agree, do not use the service.
§01Your account
You must provide a valid email address to sign in. You are responsible for keeping your API keys confidential. Any activity that occurs under your account or via your API keys is your responsibility. Notify us immediately at mail@checkmail.dev if you suspect a key has been compromised; you can also revoke any key from your dashboard.
§02Acceptable use
You agree not to use CheckMail to:
- Verify email addresses you have no legitimate business purpose to verify, including bulk-harvested or scraped lists you have not collected with consent or other lawful basis.
- Build, enrich, or sell prospect lists in violation of applicable anti-spam, privacy, or data protection laws (including the GDPR, CAN-SPAM, CASL, and the ePrivacy Directive).
- Circumvent rate limits, share keys across organisations, or resell the service without our written permission.
- Reverse engineer, probe, or attempt to disrupt the service or its underlying infrastructure.
We may suspend or terminate your account if we reasonably believe you are in violation. Suspension does not entitle you to a refund of unused credits if the violation is material.
§03Credits, payments and refunds
CheckMail is sold as pre-paid credits. One verification request consumes one credit, regardless of the result returned (including unknown and cached results). Credits never expire.
All prices on the website are in US dollars and exclude VAT. VAT is added at checkout based on your billing address; if you provide a valid EU VAT number we apply the reverse-charge mechanism.
Auto-topup, when enabled, charges your saved payment method automatically when your balance falls below your configured threshold. You can disable auto-topup at any time from your dashboard.
Because CheckMail credits are a digital service delivered immediately upon purchase, you waive your right of withdrawal under EU Directive 2011/83/EU once credits have been added to your account. Refunds are issued at our discretion in cases of clear billing error or service unavailability lasting more than 24 consecutive hours; contact mail@checkmail.dev.
§04The service
CheckMail performs syntax validation, DNS lookups, SMTP handshakes, disposable-domain detection, catch-all detection, typo suggestions, and role-based detection. Email verification is inherently probabilistic; mail servers may behave inconsistently, return greylisting responses, or accept all addresses ("catch-all"). We make no warranty as to the deliverability of any specific message based on a verification result.
We aim for high availability but do not guarantee uptime. The service is provided "as is".
§05Intellectual property
The CheckMail service, including its code, documentation, and visual identity, is the property of Bition B.V. You receive a non-exclusive, non-transferable, revocable licence to use the service for the duration of your account. Verification results returned to you may be used freely within your business.
§06Limitation of liability
To the maximum extent permitted by Dutch law, our aggregate liability for any claim arising out of these Terms or the use of the service is limited to the total amount you paid us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, incidental, or punitive damages, including lost profits or lost data.
Nothing in these Terms limits liability that cannot lawfully be limited under Dutch consumer law.
§07Changes
We may update these Terms from time to time. Material changes will be announced by email to the address on file or by a notice in the dashboard. Continued use of the service after the effective date constitutes acceptance.
§08Termination
You may stop using CheckMail at any time. We may terminate or suspend access without notice for material breach of these Terms or where required by law. Sections that by their nature should survive termination (intellectual property, limitation of liability, governing law) survive.
§09Governing law and venue
These Terms are governed by the laws of the Netherlands. Any dispute arising from or in connection with these Terms will be submitted to the exclusive jurisdiction of the courts of Oost-Brabant, Eindhoven, the Netherlands, without prejudice to mandatory consumer protection rules of your country of residence.
